Words with initial capitalization have meanings defined under the following conditions. These definitions apply whether they appear in singular or plural form.

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Services or parts of our Services.

  • Service Provider means any natural or legal person who processes data on behalf of TechSparq. Under GDPR, Service Providers are considered Data Processors.

  • Usage Data refers to data collected automatically, either generated by the use of the Services or from the Service infrastructure (e.g., page visit duration).

  • You means the individual accessing or using the Services, or the company or other legal entity on whose behalf such individual is accessing the Services.

    • Under GDPR, you may be referred to as the Data Subject.
       

2. Types of Data We Collect
We collect different types of information to provide and improve our Services. The categories of Personal Data we may collect include:

  • Identifiers: Name, email address, postal address, phone number, online identifier, IP address, account name.

  • Personal information categories listed in the California Customer Records statute: Name, signature, address, telephone number, education, employment, employment history, bank account number, credit card number, debit card number, or other financial information (some may overlap with other categories).

  • Protected classification characteristics under California or federal law: Age (if provided), race, color, ancestry, national origin, citizenship, religion, marital status, medical condition, physical or mental disability, sex, sexual orientation, veteran or military status, genetic information (if voluntarily provided).

  • Biometric information: Not collected.

  • Internet or other electronic network activity: Browsing history, search history, information on interactions with our website or advertisements.

  • Geolocation data: Approximate physical location (e.g., derived from IP address).

  • Sensory data: Audio, electronic, visual, thermal, olfactory, or similar information (e.g., if you participate in video calls).

  • Professional or employment-related information: Current or past job history or performance evaluations (if provided for job applications or services).

  • Non-public education information: Not collected.

  • Inferences drawn from other personal information: Profile reflecting preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

  • Sensitive Personal Information (under CPRA): Social security number, driver's license, passport number, account login with password, precise geolocation, racial or ethnic origin, religious beliefs, union membership, genetic data, biometric data for identification, health data, sex life or sexual orientation data (we do not knowingly collect sensitive information unless necessary for Services and with your consent where required).

We also collect Usage Data automatically, such as:

  • Device type, browser type, operating system, referring URLs, access times, pages viewed, and links clicked.

We do not collect sensitive Personal Information unless it is necessary for providing Services, and only with your explicit consent where required by law.

3. How We Collect Your Data
We collect your data in the following ways:

  • Directly from you: When you register for an account, place an order, subscribe to newsletters, fill out forms, respond to surveys, provide feedback, or communicate with us via email, phone, or other means.

We do not "sell" or "share" your Personal Information as defined under CCPA/CPRA (e.g., for cross-context behavioral advertising) without your consent. If we did, we would provide an opt-out mechanism. In the past 12 months, we have disclosed the following categories of Personal Information for business purposes: Identifiers, Commercial Information, Internet Activity, and Professional Information to Service Providers and affiliates.

6. International Transfers
TechSparq is based in the USA. If you are in the EEA or UK, your data may be transferred to and processed in the USA or other countries outside the EEA/UK. We ensure appropriate safeguards, such as Standard Contractual Clauses (SCCs) approved by the European Commission, to protect your data. For more information, contact us.

7. Data Retention
We retain your Personal Data only as long as necessary for the purposes outlined in this Policy, including for legal, accounting, or reporting requirements. For example:

  • Account data: Retained while your account is active and for 7 years thereafter for tax purposes.

  • Usage Data: Retained for up to 2 years for analytics.

When data is no longer needed, we securely delete or anonymize it.

CCPA/CPRA-Specific Rights (California Residents)

  • Opt out of the sale or sharing of your Personal Information (we do not sell/share, but if we did, use the link: Do Not Sell or Share My Personal Information).

  • Limit the use of sensitive Personal Information.

  • Correct inaccurate Personal Information.

  • Non-discrimination for exercising rights.

You may submit requests twice per 12-month period. We verify requests using information you provide. You can designate an authorized agent to make requests on your behalf. To exercise rights, use our webform at www.techsparq.com/privacy-request or email privacy@techsparq.com. We respond within 45 days (extendable to 90 days).
We recognize Global Privacy Control (GPC) signals for opt-out requests.
For other U.S. state residents, similar rights may apply under state laws (e.g., Virginia CDPA, Colorado CPA).

We use cookies and similar technologies (e.g., pixels, beacons) to enhance your experience, analyze usage, and deliver personalized content. Categories include:

Under CCPA, if we knowingly sell Personal Information of minors under 16, we require opt-in consent (for 13-15) or parental consent (under 13). We do not knowingly sell such data.
